A photographer is allowed to sell pictures they took under fair use.  Photography is art and you are allowed to sell art you create.  It's probably more like he was putting Rush logos or lyrics on the photos he was selling and jazzing them up that way or the site itself.

Photos of people, though? At an event you shot as a member of the press? I'm not sure fair-use covers that - also - I'm no lawyer, but fair use implies no selling - you can display and distribute for educational purposes, but you can't profit. My understanding of it anyway.

Famous people vs non famous have different rules though.

Are we sure of the date of these photos? Because I think it's possible they may be from earlier in 1975 touring FBN. Alex's bangs and hair length look similiar to the "Castle Session" videos of Anthem and FBN and Neil's bass drum skins sport the 1st album logo whereas on the 8 mm film from "Caught in the Act" uses the CoS font.

He says October 21st 1975 but that’s not the date they played Calgary which was September 21st. According to this tour listing they didn’t play Calgary on the FBN tour.

thanks - so I would go with Sept 21 he's just a month off, seems like a reasonable mistake.
