I think in some cases yes, you have to get permission like Bill Gates did from the Stones for Windows 95. But so long as you inform the publisher and pay the fees, there typically isn't any asking needed. I'd guess the band knew nothing of it and that Anthem just signed off on it. This is to my knowledge anyway, so I could be very wrong about it!

Does Anthem have the rights to Working Man, or is that still under Mercury?

It's a commercial I've only seen once. Doesn't change my opinion of Rush as a band or Wal-Mart as a business.

It's an interesting question. Mercury must still have the distribution rights to the actual recording of Working Man. It's possible then I'm guessing that this would give them the right to let Wal-Mart use the song without the consent of Ged, Neil and Alex. Maybe Anthem only controls Rush's publishing which means songwriting royalties would go through them. Or maybe Anthem has distribution rights in Canada only. Someone who knows about Rush's business side could chime in here. Maybe a thread could be started about Rush's business side. More questions than answers in this post, I realize. lol.

Doesn't quite fit this specific instance, since the Rush guys have been split from Mercury for a while.  That recording is under Mercury (or UMG now, I guess), and that's who they were published by at the time.  I remember hearing that a bunch of the more recent reissues/box sets aren't the most popular with the boys in the band because they aren't getting a say in them.

Of course this all depends on how WalMart got ahold of the song.  That being said, it should go without saying, that Rush and WalMart should go together like oil and water, or perhaps even repel each other.  I can't think of an artistic vision as diametrically opposed to a business philosophy as those of Rush and WalMart.

There was a song used in a car commercial a few years back. I think it was Sawyer?

 

I remember Ged or Al having said that they blessed it because they saw nothing wrong with it. It was fitting or something like that.

 

Which implies to me that they do have a say about the Mercury catalog.

Possibly easier to detect had there been any need for it? My post was in response to Grep's confusion and may have been the commercial he was thinking of. Or maybe there was a Sawyer one too.

Got it. There was a Sawyer commercial years ago, but I can't remember the car. The car burst out of a cloud of smoke right as the synth-sweep starts. I want to say Mercedes Benz, but not certain.
